Terms and Conditions

Neroliya Studio (“we”, “us” or “our”) provides the opportunity to purchase e-gift cards (each, a “Gift Card”). Your purchase or use of a Gift Card constitutes acceptance of these Terms and Conditions (“Terms”), which are subject to the Neroliya Studio Terms of Service, incorporated herein by reference.

PLEASE READ THESE TERMS AND CONDITIONS AND THE TERMS OF SERVICE CAREFULLY. By purchasing or using a Gift Card, you agree to be bound by these Terms and the Neroliya Studio Terms of Service.

1. Purchase

When purchasing a Gift Card, you may be asked to provide certain information, including but not limited to credit card number, expiration date, and billing address. You represent and warrant that you have the legal right to use any payment method provided. You acknowledge that such information will be treated according to our Privacy Policy, and you grant us the right to provide information to third parties to facilitate the transaction. Verification of information may be required prior to acceptance of any purchase.

Age Requirement: Purchasers and users must be 18 years or older.

2. Redemption

Gift Cards may only be redeemed toward eligible purchases on Neroliya Studio. The order total includes product price, applicable taxes (if applicable), shipping and any other charges reflected in the order total. If the order total exceeds the Gift Card amount, the remaining balance must be paid with another payment method. The Gift Card balance will immediately be reduced by the order total. Any unused balance remains on the Gift Card for future purchases.

Important: Promotion codes or other discounts cannot be used to purchase Gift Cards.

3. Refunds and Returns

Gift Cards cannot be returned or canceled after purchase.
Full Gift Card Payment: Refunds are credited back to the original Gift Card.
Mixed Payment (Gift Card + Other Methods): Refunds are first applied to the Gift Card until its refundable amount is exhausted, with any remaining refund returned to the other payment method.
Shopify-Specific Note: Reloading a Gift Card balance is only supported for transactions processed through Shopify Payments. For transactions not processed through Shopify Payments, Neroliya Studio reserves the right to issue a new Gift Card for the refundable amount where permitted by the payment provider and applicable laws.

4. Limitations

Promotion codes or other discounts cannot be used to purchase e-Gift Cards.
Gift Cards cannot be redeemed for cash except as required by law.
Gift Cards cannot be used to purchase other Gift Cards.
Gift Cards cannot be resold or transferred for value.

5. Risk of Loss

The risk of loss and title for Gift Cards passes to the purchaser upon electronic delivery. Neroliya Studio is not responsible if any Gift Card is lost, stolen, destroyed, or used without permission.

6. Fraud

Neroliya Studio reserves the right to refuse, cancel or hold for review Gift Cards and orders for suspected fraud, unlawful activity, or for other violations of these Terms and Conditions. We reserve the right to correct the Gift Card balance if we believe that a clerical, billing or accounting error has occurred.

7. Expiration

Gift Cards do not expire and no service fees will be assessed for non-use. Gift Cards are issued in U.S. Dollars (USD). All purchases and refunds are processed in USD and may be subject to exchange rate fluctuations.

8. Compliance with Law

By purchasing an Gift Card, you are representing to Neroliya Studio that the activities in connection with which the Gift Card will be used will comply with these Terms and Conditions and all applicable laws, rules and regulations, including the Terms of Service.

9. Limitation of Liability

NEROLIYA STUDIO MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO E-GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT AN E-GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH E-GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED.
